IS ARBITRATION BETTER THAN LITIGATION?

Arbitration means resolving disputes by submitting them to one or more private persons who are empowered under state and federal law to render a decision.  The decision will be binding and almost always final, because arbitration awards are rarely overturned by the courts. It generally means that the courts are not involved at all in the process at all (except perhaps to decide if the dispute is in fact subject to a valid arbitration agreement).  Arbitration comes about if and only if the parties have mutually agreed to arbitrate rather than go to court. Usually the agreement is in writing in advance of any dispute.  Many business contracts, from heavily negotiated documents all the way down to one-size-fits-all forms, contain arbitration clauses.
